By accessing or using our website, submitting an inquiry, requesting a quotation or sample, or engaging with our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.

These Terms should be read together with our Privacy Policy and any other policies or terms that may apply to specific products or services.

Effective Date:

Website Use

You may use the RedBird Sportswear website for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use the website for any unlawful, fraudulent, or unauthorized purpose.
  • Attempt to gain unauthorized access to the website, its systems, servers, or related services.
  • Interfere with or disrupt the operation, security, or availability of the website.
  • Introduce malicious software, harmful code, or other technologies that could damage or compromise the website.
  • Copy, reproduce, modify, distribute, or commercially exploit website content without our prior written permission.
  • Use automated systems, scraping tools, or other methods to collect website content or information in a manner that could interfere with our website or violate applicable laws.
  • Submit false, misleading, fraudulent, or unauthorized information through our forms or communication channels.
  • Use our website or content in a way that infringes the rights of RedBird Sportswear or any third party.

We reserve the right to restrict or terminate access to the website where we reasonably believe that these Terms have been violated, the website has been misused, or such action is necessary to protect our business, systems, users, or third parties.

Quotations, Orders & Agreements

Product pricing, minimum order quantities, production timelines, shipping arrangements, and other project terms may vary depending on the product specifications, materials, customization, quantity, and delivery requirements.

Any quotation provided by RedBird Sportswear is based on the information available at the time of quotation and may be subject to change if product specifications or project requirements change.

A quotation or inquiry does not create a binding agreement unless and until the relevant commercial terms are confirmed and accepted by both parties.

Once an order or manufacturing project has been confirmed, the agreed product specifications, approved samples, pricing, quantities, production requirements, and other applicable terms will form the basis of the project.

Changes requested after confirmation may affect pricing, production timelines, materials, quantities, or other agreed requirements. Any such changes may require additional confirmation before production continues.

Products, Services & Manufacturing

RedBird Sportswear provides custom sportswear and manufacturing services for brands, teams, gyms, businesses, and organizations. Our services may include product development, custom design, sampling, branding, manufacturing, quality inspection, packaging, and delivery.

Product specifications, materials, construction methods, branding options, minimum order quantities, production timelines, pricing, and other requirements may vary depending on the product and project.

Information presented on our website is provided for general informational purposes and does not constitute a binding offer, quotation, guarantee, or contractual commitment.

Any specific manufacturing project will be subject to the product specifications, quotation, sample approval, agreed terms, and other conditions confirmed between RedBird Sportswear and the customer.

Product Specifications & Sample Approval

Custom manufacturing projects are developed according to the product specifications and requirements agreed with the customer.

Customers are responsible for providing accurate designs, measurements, artwork, branding files, technical requirements, and other information required for product development.

Where a sample is produced, the customer is responsible for reviewing the sample and confirming that the relevant product specifications, fit, materials, construction, branding, and finishing details are acceptable before bulk production begins.

Once a sample or final specification has been approved, subsequent production will generally be based on that approved version. Changes requested after approval may require additional sampling, costs, materials, or production time.

RedBird Sportswear may advise customers regarding product development and manufacturing considerations, but final approval of customer-specific specifications remains the customer’s responsibility.

Custom Designs, Artwork & Intellectual Property

Customers are responsible for ensuring that the designs, logos, artwork, trademarks, images, text, patterns, and other materials they provide to RedBird Sportswear may be lawfully used for the requested products and services.

By submitting such materials, you represent that you have the necessary rights, permissions, or authorization to use and reproduce them for the relevant project.

You retain ownership of your intellectual property, subject to any separate agreement between you and RedBird Sportswear.

You authorize RedBird Sportswear to use customer-provided designs, artwork, trademarks, and related materials only as reasonably necessary to develop, sample, manufacture, brand, and fulfill the products or services requested by you.

RedBird Sportswear does not knowingly claim ownership of customer-provided intellectual property. However, we are not responsible for determining whether customer-provided materials infringe the intellectual property rights of another party.

If we reasonably believe that submitted materials may violate applicable law or third-party rights, we may decline to use those materials or request appropriate authorization before proceeding.

Pricing, Payments & Production Costs

Pricing for custom products and manufacturing services depends on factors such as product type, quantity, materials, customization, branding, packaging, sampling, and delivery requirements.

Prices and payment terms will be communicated to the customer as part of the applicable quotation or commercial agreement.

Additional costs may apply where the customer requests changes to approved specifications, additional samples, special materials, additional customization, revised quantities, or other services outside the originally agreed requirements.

Production will proceed according to the payment terms and conditions agreed between RedBird Sportswear and the customer. Any applicable deposits, balances, or other payment requirements must be fulfilled according to the agreed terms.

RedBird Sportswear reserves the right to pause or delay production where required payments or necessary customer approvals have not been received.

Production Timelines & Delays

Estimated production timelines may vary depending on product type, order quantity, materials, customization, sampling requirements, customer approvals, and other project-specific factors.

Any production or delivery timeframe provided by RedBird Sportswear is an estimate unless a specific deadline has been expressly agreed in writing.

Production timelines may be affected by delays outside our reasonable control, including delays in receiving customer approvals, materials, artwork, payments, shipping services, customs clearance, supplier availability, natural events, government actions, or other unforeseen circumstances.

Where a delay occurs, we will make reasonable efforts to communicate relevant information and continue the project as circumstances permit.

Delivery or shipping time is separate from manufacturing time unless otherwise stated in the applicable quotation or agreement.

Shipping & Delivery

RedBird Sportswear may arrange worldwide shipping for confirmed orders according to the delivery terms agreed with the customer.

Shipping costs, delivery methods, estimated transit times, and applicable responsibilities may vary depending on the destination, order size, shipping method, and other project requirements.

Manufacturing time and shipping transit time are separate unless otherwise specified in the applicable quotation or agreement.

Customers are responsible for providing accurate and complete delivery information. Delays or additional costs resulting from incorrect or incomplete information may be the customer’s responsibility.

International shipments may be subject to customs duties, taxes, import charges, clearance requirements, or other fees imposed by the destination country. Unless otherwise agreed in writing, such charges are the responsibility of the customer.

Once an order has been handed over to the applicable shipping carrier, delivery may be affected by circumstances outside RedBird Sportswear’s reasonable control, including customs processing, carrier delays, weather, transportation disruptions, or other unforeseen circumstances.

Returns, Defective Products & Claims

Because RedBird Sportswear primarily provides custom-manufactured products made according to customer-approved specifications, returns, replacements, and refunds may be subject to the terms agreed for each individual order.

Customers should inspect delivered products within a reasonable period after receipt and notify RedBird Sportswear promptly if they identify a significant defect, incorrect specification, shortage, or other issue relating to the agreed order.

Where a claim is made, we may request relevant information such as photographs, product details, quantities affected, packaging information, or other evidence reasonably necessary to evaluate the issue.

If an issue is determined to be attributable to a manufacturing error or failure to meet the agreed specifications, RedBird Sportswear will work with the customer to determine an appropriate resolution in accordance with the applicable order terms.

Issues resulting from customer-approved specifications, customer-supplied materials or artwork, improper use, normal wear and tear, or modifications made after delivery may not qualify for a return, replacement, refund, or other remedy.

Specific return, replacement, refund, or claim procedures may also be set out in a separate Returns & Refund Policy or the applicable quotation or commercial agreement.

Warranty & Product Use

RedBird Sportswear aims to manufacture products according to the specifications and requirements approved for each customer project.

Unless a specific warranty is provided in writing as part of an applicable quotation or agreement, no separate warranty is created solely by information published on this website.

Customers are responsible for using, storing, washing, maintaining, and handling products in accordance with their intended purpose and any applicable care or usage instructions.

RedBird Sportswear is not responsible for damage, defects, or performance issues resulting from misuse, improper care, unauthorized modifications, excessive wear, accidents, or use outside the product’s intended purpose.

Any specific warranty, quality commitment, or product remedy agreed for an individual order will be governed by the applicable written terms of that order.

Limitation of Liability

To the maximum extent permitted by applicable law, RedBird Sportswear will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to the use of our website, products, services, or manufacturing arrangements.

This may include, where legally permitted, loss of profits, loss of business opportunities, loss of revenue, loss of data, business interruption, or other indirect losses.

RedBird Sportswear is not responsible for losses or damages resulting from circumstances beyond our reasonable control, including third-party service failures, shipping or customs delays, inaccurate information provided by customers, unauthorized use of the website, or events outside our reasonable control.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless RedBird Sportswear, its employees, representatives, and service providers from claims, liabilities, damages, losses, costs, and reasonable expenses arising from:

  • Your misuse of our website or services.
  • Your violation of these Terms.
  • Your violation of applicable laws or regulations.
  • Your infringement or alleged infringement of another party’s intellectual property or other rights.
  • Designs, artwork, trademarks, logos, materials, or other content supplied by you for a custom manufacturing project.
  • Information or instructions provided by you that result in a claim, loss, or dispute.

This obligation does not apply to the extent that a claim results from RedBird Sportswear’s own unlawful conduct or other circumstances for which applicable law does not permit indemnification.

Website Content & Intellectual Property

All content and materials appearing on the RedBird Sportswear website, including text, graphics, logos, photographs, images, videos, page layouts, designs, and other original materials, are owned by or licensed to RedBird Sportswear unless otherwise stated.

You may access and view website content for your personal or legitimate business purposes. You may not reproduce, copy, modify, republish, distribute, transmit, sell, or commercially exploit our website content without our prior written permission.

The RedBird Sportswear name, logo, trademarks, branding, and other proprietary materials may not be used in a way that suggests an unauthorized affiliation, endorsement, partnership, or sponsorship.

Customer-provided trademarks, logos, designs, artwork, and other intellectual property remain subject to the ownership and usage rights described in the applicable customer agreement and Section 6 — Custom Designs, Artwork & Intellectual Property.

Third-Party Links & Services

Our website may contain links to third-party websites, platforms, applications, or services that are not owned or controlled by RedBird Sportswear.

These links may be provided for convenience or to provide additional information. Accessing a third-party website or service is at your own discretion and may be subject to that third party’s own terms, conditions, and privacy policies.

RedBird Sportswear does not control and is not responsible for the content, availability, security, accuracy, or practices of third-party websites or services.

The inclusion of a third-party link does not necessarily constitute an endorsement, partnership, or recommendation by RedBird Sportswear.

Events Beyond Our Reasonable Control

RedBird Sportswear will not be responsible for failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, fire, flood, epidemic or pandemic events, war, civil unrest, strikes, labor disruptions, government actions, changes in laws or regulations, transportation disruptions, supply-chain interruptions, utility failures, internet or telecommunications failures, customs delays, or failures of third-party service providers.

Where such circumstances affect a project, we will make reasonable efforts to communicate the situation and resume or continue performance as soon as reasonably practicable.

Any affected production or delivery timelines may be reasonably adjusted to account for the duration and impact of the event.

Governing Law & Dispute Resolution

These Terms & Conditions and your use of the RedBird Sportswear website and services will be governed by the applicable laws of the jurisdiction in which RedBird Sportswear is legally established, unless otherwise required by applicable law or agreed in writing between the parties.

Any dispute arising from or relating to these Terms, our services, or a specific manufacturing project should first be addressed through good-faith communication between the parties with the aim of reaching a mutually acceptable resolution.

If a dispute cannot be resolved through direct communication, it may be referred to the courts or other dispute-resolution process having appropriate jurisdiction, subject to applicable law and any separate written agreement between RedBird Sportswear and the customer.

Nothing in this section prevents either party from exercising any rights or remedies that cannot lawfully be excluded or restricted.

Termination

RedBird Sportswear may suspend or terminate your access to our website where reasonably necessary, including where you violate these Terms, misuse the website, engage in unlawful activity, or create a security or operational risk.

You may stop using our website at any time.

Termination or suspension of website access does not affect rights, obligations, or provisions that by their nature are intended to continue after termination, including provisions relating to intellectual property, payment obligations, limitation of liability, indemnification, governing law, and dispute resolution.

Any confirmed manufacturing order or separate agreement will remain subject to its applicable terms unless otherwise agreed by the parties or required by applicable law.

Changes to These Terms

RedBird Sportswear may update these Terms & Conditions from time to time to reflect changes to our website, services, business practices, or applicable legal requirements.

When changes are made, the updated version will be published on this page and the Effective Date will be revised accordingly.

We encourage you to review these Terms periodically to remain informed about the conditions that apply to your use of our website and services.

Your continued use of the website after updated Terms are published constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
